By using the Services, you acknowledge the practices described in this Privacy Policy. If you use the Services on behalf of a business or other organization, you represent that you are authorized to provide information to us and to act on that organization’s behalf.

3. Cookies and Similar Technologies

We and our service providers may use cookies, pixels, local storage, and similar technologies to keep you signed in, remember preferences, understand use of the Services, measure performance, prevent fraud, and improve functionality.

Most browsers allow you to control cookies through their settings. Disabling certain cookies or storage technologies may prevent portions of the Services from functioning properly. Where required by law, we will provide additional notice or choices regarding nonessential cookies.

4. How We Disclose Information

We may disclose information in the following circumstances:

Service Providers

We may disclose information to vendors that help us provide the Services, including providers of hosting, databases, authentication, email, customer support, analytics, security, payment processing, mapping, geocoding, routing, route optimization, property information, and ownership information. These providers may process information only for the services they provide to us, subject to their agreements and applicable law.

Your Organization and Authorized Users

If your account belongs to a business or organization, account owners and authorized users may access information associated with that account. An organization may manage accounts, permissions, records, and other content within its workspace.

Legal, Safety, and Rights Protection

We may disclose information if we reasonably believe disclosure is necessary to comply with law, regulation, legal process, or governmental request; enforce our agreements; collect amounts owed; detect or prevent fraud, abuse, or security incidents; or protect the rights, property, or safety of PoolHunter, our users, or others.

Business Transfers

We may disclose or transfer information in connection with a merger, acquisition, financing, reorganization, bankruptcy, sale of assets, or similar corporate transaction. Any successor may continue to process information as described in this Privacy Policy unless otherwise required by law.

With Your Direction or Consent

We may disclose information when you direct us to do so, authorize an integration, or otherwise consent.

Aggregated or De-identified Information

We may use and disclose aggregated or de-identified information for lawful business purposes, including analytics, benchmarking, research, and improvement of the Services, provided that we do not attempt to re-identify it except as permitted by law.

PoolHunter does not sell personal information for money. We may use service providers for analytics or advertising in ways that could be treated as “sharing,” “targeted advertising,” or a “sale” under certain privacy laws. Where applicable, we will provide legally required notices and opt-out methods.

5. Customer Data and Business Records

Businesses using PoolHunter may upload or create records relating to their customers, prospects, employees, properties, and routes (“Customer Data”). The subscribing business controls its Customer Data and is responsible for having the necessary rights and lawful basis to collect, upload, use, and direct us to process it.

PoolHunter generally processes Customer Data to provide the Services on behalf of the subscribing business. If you are an individual whose information was entered into PoolHunter by one of our customers, please direct requests concerning that information to the relevant PoolHunter customer. We may assist our customer with a request where required by law or contract.

Customers may not use personal or property-owner information obtained through the Services for unlawful discrimination, harassment, stalking, intimidation, deceptive practices, or communications that violate privacy, telemarketing, advertising, or do-not-contact laws.

6. Data Retention

We retain information for as long as reasonably necessary to provide the Services, administer accounts, complete transactions, comply with legal obligations, resolve disputes, enforce agreements, maintain security, and support legitimate business operations.

Retention periods vary depending on the type of information and why it was collected. Following account closure, we may retain certain information for a limited period in backups or where required for legal, security, fraud-prevention, tax, accounting, or dispute-resolution purposes. We may retain aggregated or de-identified information indefinitely.

7. Data Security

We use reasonable administrative, technical, and organizational safeguards designed to protect information. However, no method of transmission, storage, or security is completely secure. We cannot guarantee that information will never be accessed, used, or disclosed improperly.

You are responsible for maintaining the confidentiality of your credentials, using appropriate security controls, and promptly notifying us if you suspect unauthorized access to your account.

8. Your Choices and Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have rights to request access to, correction of, deletion of, or a copy of certain personal information; to object to or restrict certain processing; or to opt out of certain sales, sharing, targeted advertising, or profiling.

If information is controlled by a PoolHunter customer, we may direct you to that customer.

9. Third-Party Services and Links

The Services may rely on or link to third-party services, including payment, mapping, routing, property-data, and authentication services. Those third parties may process information under their own privacy policies. PoolHunter is not responsible for the privacy, security, or content of third-party services that we do not control.
