PoolHunter Terms of Service

Effective date: September 21, 2026

These Terms of Service (the “Terms”) are a binding agreement between PoolHunter LLC (“PoolHunter,” “we,” “us,” or “our”) and the person or entity accessing or using poolhunter.com, the PoolHunter application, or any related software, data, features, or services (collectively, the “Services”).

By creating an account, purchasing a subscription, or accessing or using the Services, you agree to these Terms. If you use the Services for a company or other organization, you represent that you have authority to bind that organization, and “you” includes that organization. If you do not agree to these Terms, do not use the Services.

1. Eligibility and Business Use

You must be at least 18 years old and legally capable of entering into a contract. The Services are intended primarily for business and professional use. You may use the Services only in compliance with these Terms and all applicable laws.

2. Accounts and Authorized Users

You must provide accurate, current, and complete account information and keep it updated. You are responsible for:

  • Maintaining the confidentiality and security of account credentials;

  • All activity conducted through your account;

  • Ensuring that authorized users comply with these Terms; and

  • Promptly notifying us at support@poolhunter.com of suspected unauthorized access or misuse.

Accounts and credentials may not be shared outside the single business or organization that purchased the applicable subscription. Each separate business may be required to maintain its own account or subscription. You may not misrepresent your identity, business, authority, or affiliation.

3. The Services

PoolHunter provides tools that may help users understand service territories, review property-related information, organize prospects and customers, evaluate route density, and plan or optimize routes. Features may depend on third-party data and services.

We may add, remove, modify, suspend, or discontinue any portion of the Services at any time. We do not guarantee that any specific feature, integration, data source, geographic market, or functionality will remain available. We may release beta, preview, or experimental features that are provided as-is and may be changed or withdrawn without notice.

The Services do not replace your independent business judgment. PoolHunter does not guarantee leads, customers, revenue, savings, route performance, property conditions, ownership, regulatory compliance, or business results.

4. License and Ownership

Subject to these Terms and payment of applicable fees, PoolHunter grants you a limited, nonexclusive, nontransferable, non-sublicensable, revocable right to access and use the Services during your subscription term for your internal business operations.

PoolHunter and its licensors retain all rights, title, and interest in the Services, including the software, interfaces, designs, documentation, trademarks, methods, compilations, and underlying technology. No rights are granted except those expressly stated in these Terms.

You may provide feedback or suggestions. You grant PoolHunter a perpetual, irrevocable, worldwide, royalty-free right to use and incorporate that feedback without restriction or compensation, provided we do not publicly identify you as its source without permission.

5. Your Data

You retain the rights you have in information, records, files, and other content you submit to the Services (“Customer Data”). You grant PoolHunter and its service providers a worldwide, nonexclusive right to host, copy, transmit, display, modify, and otherwise process Customer Data as necessary to provide, secure, maintain, support, and improve the Services; enforce these Terms; and comply with law.

You represent and warrant that:

  • You have all rights, permissions, notices, and lawful bases necessary to provide and use Customer Data through the Services;

  • Your Customer Data and instructions do not violate law, contract, privacy, intellectual-property, or other rights;

  • You will comply with applicable privacy, marketing, telemarketing, advertising, consumer-protection, and do-not-contact requirements; and

  • You will not use personal or property-owner information for unlawful discrimination, harassment, stalking, intimidation, deception, or other unlawful purposes.

You are responsible for maintaining appropriate copies of Customer Data. Except where required by law, PoolHunter is not obligated to retain or return Customer Data following termination or expiration. We may delete Customer Data after account closure, subject to reasonable backup, legal, fraud-prevention, and security retention.

6. Property, Ownership, Mapping, and Routing Data

The Services may display or derive information from public records, licensed datasets, maps, geocoding services, routing services, user submissions, and other third-party sources. This information may be incomplete, unavailable, delayed, duplicated, or inaccurate.

PoolHunter does not warrant or independently verify:

  • The presence, absence, condition, or characteristics of a pool or property;

  • Property ownership, contact information, valuation, sale status, permit status, or other property facts;

  • Geographic coordinates, boundaries, distances, travel times, directions, route order, or road conditions; or

  • Whether contacting a person or property is lawful, appropriate, or commercially advisable.

Routing and optimization results are estimates and may not account for traffic, weather, closures, vehicle limitations, access restrictions, safety conditions, technician requirements, service duration, or other real-world factors. You are solely responsible for verifying information and exercising appropriate judgment before driving, contacting a person, marketing, purchasing a route, making staffing decisions, or taking other action.

7. Acceptable Use and Fair Use Policy

The Services are designed for the normal internal operations of legitimate pool service businesses. Access is subject to published plan limits and this Fair Use Policy, even if a particular technical limit is not displayed or automatically enforced.

You may not, directly or indirectly:

1. Scrape or extract data. Use bots, crawlers, scripts, browser automation, or similar means to scrape, harvest, copy, download, or bulk extract data, maps, records, search results, or other content from the Services, except through an export feature expressly provided by PoolHunter for your Customer Data. 2. Circumvent limits. Evade plan limits, quotas, rate limits, access controls, or security measures; create multiple accounts to avoid restrictions; or split one business’s usage across accounts to obtain benefits not included in its plan. 3. Share accounts improperly. Share credentials or provide access outside the single business or organization subscribing to the Services, or permit more users, territories, locations, properties, routes, or other usage than the applicable plan allows. 4. Resell or redistribute. Sell, sublicense, publish, redistribute, disclose, timeshare, white-label, bureau, or commercially exploit the Services or data obtained through them; operate the Services for the benefit of unaffiliated third parties; or use the Services to create a competing dataset, directory, product, or service. 5. Generate excessive usage or cost. Submit an unreasonable volume of searches, imports, exports, property requests, mapping requests, route calculations, optimizations, API calls, background refreshes, or other operations that materially exceeds ordinary usage by similarly situated customers, imposes disproportionate third-party costs, threatens system performance, or interferes with other users. 6. Misuse personal information. Use property-owner, customer, prospect, or other personal information unlawfully or for harassment, stalking, intimidation, discrimination, deception, spam, or communications that violate privacy, telemarketing, advertising, or do-not-contact laws. 7. Interfere with the Services. Probe, scan, or test vulnerabilities; bypass authentication; introduce malicious code; disrupt the Services; attempt unauthorized access; or burden our infrastructure. 8. Reverse engineer or copy. Reverse engineer, decompile, disassemble, translate, frame, mirror, reproduce, or create derivative works from the Services except to the limited extent a restriction is prohibited by law. 9. Use the Services unlawfully. Use the Services in violation of law, contract, court order, third-party rights, or these Terms, or assist another person in doing so.

Fair-Use Enforcement

PoolHunter may evaluate fair use based on factors including your plan, number of authorized users, territories, locations, monitored properties, imports, routes, calculations, optimization requests, request frequency, automated activity, third-party data or infrastructure costs, usage patterns of similarly situated customers, and impact on the Services.

If we believe usage is excessive, abusive, unsafe, unlawful, or inconsistent with the intended use of your plan, we may, at any time and with or without prior notice:

  • Apply or reduce rate limits;

  • Delay, block, or restrict particular requests or features;

  • Require you to stop automated or abnormal activity;

  • Require an upgrade, add-on, separate commercial agreement, or usage-based arrangement before permitting the usage to continue;

  • Suspend or terminate users, features, or the account; or

  • Take other reasonable measures to protect PoolHunter, its providers, and other users.

We will not impose new usage-based charges without your agreement, but we may refuse to continue usage that is not included in your plan. Published numerical plan limits control wherever they differ from general fair-use considerations. Failure to enforce a limit on one occasion does not waive our right to enforce it later.

8. Subscriptions, Fees, and Payment

Some Services require a paid subscription. Prices, included usage, features, limits, and billing intervals are shown at purchase or in an applicable order. You authorize PoolHunter and its payment processor to charge the payment method on file for recurring fees, taxes, and other amounts you approve.

Subscriptions automatically renew for successive periods equal to the initial billing period unless canceled before renewal. You are responsible for applicable taxes other than taxes imposed on PoolHunter’s net income.

We may change prices or plan features prospectively. We will provide notice of a material price increase before it applies to a renewal, as required by law. Continued use after the effective date constitutes acceptance of the new price.

If payment is late, declined, reversed, disputed, or otherwise not received, we may retry payment, suspend access, downgrade the account, or terminate the Services. You remain responsible for accrued amounts and reasonable collection costs to the extent permitted by law.

9. Cancellation and Refunds

You may cancel a paid subscription at any time through available account controls or by contacting support@poolhunter.com. Cancellation stops future renewals and becomes effective at the end of the then-current paid billing period. You may continue using the paid Services through that date unless access is suspended or terminated under these Terms.

Except where required by law or expressly stated otherwise, payments are noncancelable and nonrefundable. We do not provide credits or refunds for partial billing periods, unused time, unused features, plan downgrades, or failure to use the Services.

10. Suspension and Termination by PoolHunter

To the fullest extent permitted by law, PoolHunter may suspend, restrict, downgrade, or terminate your access to any or all of the Services at any time, with or without notice, for any reason or no stated reason, including if:

  • You violate these Terms or the Fair Use Policy;

  • Payment is overdue, disputed, reversed, or unsuccessful;

  • Your use creates security, legal, reputational, operational, or third-party-provider risk;

  • Your usage is excessive or imposes disproportionate costs;

  • We suspect fraud, abuse, unlawful conduct, or unauthorized access;

  • A provider restricts data, infrastructure, or functionality needed to serve you; or

  • We modify or discontinue the Services.

Where practical, we may provide notice and an opportunity to cure, but we are not required to do so. We may immediately suspend or terminate access where we believe delay could cause harm, liability, security risk, unlawful activity, service disruption, or material cost.

If we terminate a paid subscription solely for our convenience and not because of your conduct, risk, payment failure, or violation, we may provide a prorated refund of prepaid fees for the unused portion of the terminated subscription. No refund is due when suspension or termination results from your conduct, breach, payment issue, excessive usage, or violation of these Terms or the Fair Use Policy, except where required by law.

Upon termination, your right to use the Services ends. Sections that by their nature should survive will survive, including ownership, payment obligations, disclaimers, limitations of liability, indemnification, dispute provisions, and general terms.

11. Third-Party Services

The Services may interoperate with or depend on third-party services and data. Your use of a third-party service may be subject to that provider’s terms and privacy policy. PoolHunter does not control and is not responsible for third-party services, data, availability, acts, omissions, changes, or security.

We may change, replace, or discontinue any third-party provider or integration at any time. Loss or modification of third-party access may affect PoolHunter features and does not create liability or an obligation to continue a feature.

12. Confidentiality

Each party may receive nonpublic information that a reasonable person would understand to be confidential. The receiving party will use such information only to perform or exercise rights under these Terms and will protect it using reasonable care. This obligation does not apply to information that is public through no breach, already lawfully known, independently developed without use of the confidential information, or lawfully received without restriction.

A party may disclose confidential information where legally required after providing notice when legally permitted. PoolHunter may disclose information to employees, contractors, and service providers who need it to provide the Services and are subject to appropriate confidentiality obligations.

13. Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SERVICES AND ALL DATA, CONTENT, RESULTS, AND THIRD-PARTY MATERIALS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” POOLHUNTER DISCLAIMS ALL EXPRESS, IMPLIED, STATUTORY, AND OTHER WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, SECURITY, AND QUIET ENJOYMENT.

POOLHUNTER DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, COMPLETE, CURRENT, OR ACCURATE; THAT DEFECTS WILL BE CORRECTED; OR THAT USE OF THE SERVICES WILL PRODUCE ANY PARTICULAR BUSINESS, MARKETING, CUSTOMER, ROUTE, FINANCIAL, OR OPERATIONAL RESULT.

Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

14. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, POOLHUNTER AND ITS OWNERS, AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL, OR PUNITIVE DAMAGES; LOSS OF PROFITS, REVENUE, SAVINGS, BUSINESS, GOODWILL, USE, OR DATA; BUSINESS INTERRUPTION; COST OF SUBSTITUTE SERVICES; OR CLAIMS ARISING FROM THIRD-PARTY DATA, PROPERTY INFORMATION, DIRECTIONS, ROUTING, MARKETING, CONTACT, OR BUSINESS DECISIONS, EVEN IF ADVISED OF THE POSSIBILITY.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE TOTAL AGGREGATE LIABILITY OF POOLHUNTER AND THE OTHER POOLHUNTER PARTIES FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICES OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO POOLHUNTER FOR THE SERVICES DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS ($100).

The limitations apply regardless of the form of action and even if a remedy fails of its essential purpose. Some jurisdictions do not allow certain limitations, so portions of this section may not apply to you.

15. Indemnification

To the fullest extent permitted by law, you will defend, indemnify, and hold harmless PoolHunter and its owners, affiliates, officers, employees, contractors, licensors, and service providers from claims, damages, judgments, losses, liabilities, penalties, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:

  • Your Customer Data;

  • Your use or misuse of the Services or third-party data;

  • Your marketing, communications, driving, routing, property, customer, prospect, employment, or business activities;

  • Your violation of these Terms, law, or third-party rights; or

  • Use of your account by you or an authorized user.

PoolHunter may control the defense and settlement of a covered claim. You will cooperate and may not settle a claim in a manner that admits liability by or imposes obligations on PoolHunter without our written consent.

16. Governing Law and Disputes

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles. The state and federal courts located in Jefferson County, Alabama will have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Services, and each party consents to personal jurisdiction and venue in those courts.

Before filing a claim, each party agrees to make a good-faith effort for at least 30 days to resolve the dispute informally after written notice describing the dispute and requested resolution. Either party may seek immediate injunctive or equitable relief where necessary to protect security, confidential information, intellectual property, or prevent unauthorized use.

17. Changes to These Terms

We may modify these Terms from time to time. We will post the revised Terms and update the effective date. For material changes, we may provide additional notice through the Services or by email. Unless a later date is stated, revised Terms become effective when posted.

If you do not agree to revised Terms, you must stop using the Services and cancel your subscription. Continued use after revised Terms become effective constitutes acceptance to the extent permitted by law.

18. General Terms

  • Entire Agreement. These Terms, our Privacy Policy, and any applicable order or written addendum constitute the entire agreement concerning the Services and supersede prior discussions or agreements on that subject.

  • Order of Precedence. If an expressly signed written agreement conflicts with these Terms, the signed agreement controls to the extent of the conflict.

  • Assignment. You may not assign or transfer these Terms without our written consent. PoolHunter may assign these Terms in connection with a merger, financing, reorganization, sale of assets, change of control, or by operation of law.

  • Force Majeure. PoolHunter is not liable for delay or failure caused by events beyond its reasonable control, including natural disasters, utility or internet failures, labor disputes, government action, war, terrorism, epidemics, provider failures, or cyberattacks.

  • No Waiver. Failure to enforce a provision is not a waiver.

  • Severability. If a provision is unenforceable, it will be modified to the minimum extent necessary or severed, and the remaining provisions will remain effective.

  • No Third-Party Beneficiaries. These Terms create no third-party beneficiary rights.

  • Relationship. The parties are independent contractors. These Terms do not create an employment, partnership, agency, fiduciary, or franchise relationship.

  • Electronic Communications. You consent to receiving agreements, notices, and records electronically. Electronic communications satisfy legal writing requirements to the extent permitted by law.

  • Headings. Headings are for convenience only and do not affect interpretation.
